Help Stop Human and Child Rights Violations in Lithuania Perpetrated by Lithuanian Officials

We are Americans and Lithuanians concerned about serious violations of human rights in Lithuania who are appealing to the values and strong commitment of the U.S. to advance and protect human rights in various areas of the world.  We are especially hopeful, since Secretary Clinton has been in Lithuanian on several occasions to advance a safe, secure, and supportive environment through the Enhanced Partnership Program, and she is familiar with many issues that the young democracy in Lithuania is facing.  Since U.S. businesses are among the largest investors in Lithuania, we believe that the attention of the U.S. government to human rights violations serves their self-interest by ensuring a safe environment for its citizens in Lithuania. 

We understand that U.S. Ambassador Derse has been residing in Lithuania, and she has been able to familiarize herself with most human rights issues.  The fact that there is no obvious gun violence on the streets perpetrated by the Lithuanian government against its citizens does not mean that their rights are not being violated.  We ask that Ambassador Derse would consult about the situation in Lithuania not only with the 15% of Lithuanians (or the media sources that exist to meet their needs) who have been relatively satisfied with the functioning of the legal and political institutions in Lithuania, since they serve their interests, but also with the representatives of the 85% (according to an E.U. survey) of Lithuanians who do not trust the legal system due to the rampant injustice and corruption perpetrated by the judges and politicians. 

The situation that is of particular concern among most Lithuanians and motivated us to plea with the U.S. Department of State to make a public statement requesting transparency, justice, and protection of human rights is related to a several year old pedophilia case involving an eight-year-old girl, Deimante Kedyte.  Injustice, violation of her rights, and even violence directed by Lithuanian officials against this helpless and voiceless child signaled that all the lines have been crossed by corrupt judges.  Deimante’s situation symbolizes the status of many individuals in Lithuania today.  That is why many Lithuanians spend day and night by Deimante’s home showing support and readiness to protect this child from Lithuanian officials with their bodies.  It is an extremely tragic state of affairs when the Lithuanian people need to protect innocent children from their government, so that it would not violate their rights.  We hope that you will attempt to listen to the representatives of the 85% of Lithuanians who are disempowered and about how they feel about this case.  Please do not approach our petition with only the attitude of the 15% of individuals who are invested in corrupt Lithuanian governmental institutions, so they would continue to serve their interests and help to cover up their crimes.  

On 3/22/2012, Judge Kondratjevas approved using force for removing “obstacles” when transferring Deimante to her biological mother whom Deimante accused of selling her to pedophiles (this is the same judge who fabricated “crime evidence” against one Lithuanian citizen who recently fled to the U.S., and the U.S. District Court for the Northern District of Illinois Eastern Division refused to extradite him to Lithuania as noted In the Matter of the Extradition of Sarunas Paberalius).  The tragedy and severe injustice that is being perpetrated by the prosecutors and judges against Deimante is connected to the fact that her testimony about the perpetrators of pedophilia by very powerful individuals in Lithuanian politics, the legal system, and businesses is being ignored, and they have invested all their forces in transferring the girl to her mother (the alleged accomplice of the perpetrators of pedophilia) before the pedophilia case has been resolved.  Earlier, one court in Vilnius determined that there was enough evidence to start legal proceedings against the Deimante’s mother, Laimute Stankunaite, but the prosecutors have been delaying her indictment.  Incredibly, one prosecutor declared he wanted to see Deimante’s mother represent her in this case!  First, the judges subjected Deimante to multiple unethical psychological evaluations where she persistently witnessed against her mother and pedophiles, and her testimony was found to be valid.  Since they were not able to obtain testimony from this traumatized, but resilient child that would be convenient for the perpetrators of pedophilia whom they have been desperately trying to find innocent, they decided to completely ignore her testimony and ordered that Deimante would be transferred to her mother in order to close the case.

On 3/23/2012, we were horrified witnesses of the violence that was perpetrated in the name of the Republic of Lithuanian in an attempt to pull out of the hands of her grandmother a frightened and screaming child who kept repeating she did not want to go with her mother (http://www.youtube.com/watch?v=Ax3lwQmZye8&feature=related).  Force was used against the girl by masked guards and her biological mother, Laimute Stankunaite, who attempted to drag Deimante out of the house.  Moreover, Deimante’s grandmother, an elderly person, and her sister were physically abused by the masked guards in front of the child.  The bailiff, Sonata Vaicekauskiene, came against this victim of pedophilia and the last living witness in this case with at least 30 armed policemen ready to seize her in order to protect those who are responsible for this child’s sex trafficking and abuse (http://www.youtube.com/watch?v=5kTrzg9kmBE&feature=player_embedded).

This terrorizing of a little child that was approved of and perpetrated by Lithuanian officials was videotaped and numerous people from Lithuania, America, and other countries watched it with horror and disbelief.  Almost 10,000 of them have currently signed a petition demanding that Lithuanian officials stop the aggression and violence against this innocent girl (http://www.change.org/petitions/lithuanian-justice-and-national-security-office-stop-using-force-and-violence-against-an-8-year-old-child-deimante-kedytehttp://www.change.org/petitions/lithuanian-justice-and-national-security-office-stop-using-force-and-violence-against-an-8-year-old-child-deimante-kedyte). 

The violent campaign against Deimante on 3/23/2012 did not succeed because of one child protection worker who did not allow herself to be intimidated by the bailiff and police chief into helping them complete their terrorizing act against the panic stricken and physically injured child.  Now, the bailiff is training her forces and planning a more aggressive campaign against this girl that would not fail.  Lithuanian officials are now considering using tranquilizers or chemical restrain on this child, so that she will return to her mother without protest.  At this time, the bailiff issued an ultimatum that Deimante’s guardian must transfer Deimante to her biological mother by 04/26/12; otherwise, the bailiff will use multiple police and special forces again to remove all “obstacles” to transferring this girl to her biological mother against her will.  The repetitive violence and force that traumatizes this innocent child must be stopped before that day comes.

We are convinced that it is inhumane and goes against any kind of common sense to forcibly transfer Deimante against her clearly expressed and documented will to her mother whom she accused of selling her to pedophiles and who has not yet been indicted despite the sufficient evidence against her.  Deimante must be guaranteed due process in the pedophilia case, which would insure her right to witness and/or have her prior valid testimonies included among the major evidence. 

We ask that the U.S. Department of State would express its position regarding this situation, since the violations of Deimante’s rights are set against not just common sense, the Lithuanian Constitution, and Lithuanian laws, but several provisions of the United Nations Convention on the Rights of the Child that was ratified by Lithuania in 1995.  We respectfully ask that you would treat this situation as you do other human rights violations in the world.  We are confident that you do not accept Iranian President Ahmadinejad’s explanation that Yousef Nadarkani’s death sentence is not a matter of human rights violations, since it is according Iranian law.  Therefore, we do believe that you will not consult about the pedophilia case those officials in Lithuania who are invested in distorting the evidence and protecting the perpetrators, but find some reliable and independent source.  We have had enough deaths in this case, including the girl’s father, D. Kedys.  Therefore, we think that the safest place for the girl is her residence with her aunt, Neringa Venckiene, where the girl has been raised for several years.  Only one condition is necessary to further ensure the girl’s safe environment with her aunt; the judges and governmental officials must stop harassing and intimidating her aunt for trying to care for Deimante and protect her rights.

Mes, amerikiečiai ir lietuviai, esame susirūpinę rimtais žmogaus teisių pažeidimais Lietuvoje ir apeliuojame į Jungtinių Valstijų vertybes bei ryžtą įtvirtinti bei apginti žmogaus teises įvairiose pasaulio dalyse. Turime nemažai vilties, nes sekretorė Clinton kelis kartus lankėsi Lietuvoje palaikydama saugią ir palaikančią aplinką per Sustiprintos partnerystės programą; ji gerai žino, kokius iššūkius patiria jauna Lietuvos demokratija. Kadangi JAV įmonės yra vieni didžiausių investuotojų Lietuvoje, tikimės, kad Jungtinių Valstijų vyriausybės dėmesys žmogaus teisių pažeidimams pasitarnaus JAV interesams, užtikrindamas saugią aplinką jos piliečiams Lietuvoje.

Žinoma, JAV ambasadorė Anne E. Derse reziduoja Lietuvoje, ji galėjo susipažinti su žmogaus teisių padėtimi. Tai, kad Lietuvos pareigūnai atvirai nesmurtauja prieš savo piliečius šaudydami juos gatvėse, visai nereiškia, kad žmogaus teisų yra paisoma. Prašome, kad JAV ambasadorė Derse apie žmogaus teisų padėtį pasikonsultuotų ne tik su 15 proc. lietuvių (ar žiniasklaida, kuri aptarnauja jų pažiūras), kurie yra gana patenkinti tuo, kaip dirba politinės ir teisinės institucijos Lietuvoje, nes jos aptarnauja jų interesus, bet ir su 85 proc. (kaip tvirtina ES atlikta apklausa) Lietuvos gyventojų dalies atstovais, kurie nepasitiki teisine sistema dėl gausių neteisingumo ir korupcijos atvejų, kuriuos atlieka teisėjai ir politikai.

Susidariusi padėtis kelia ypatingą rūpestį daugumai lietuvių. Tai paskatino mus kreiptis į JAV valstybės departamentą su viešu pareiškimu, reikalaujančiu skaidrumo, teisingumo ir žmogaus teisių apsaugos keleto metų senumo pedofilijos byloje, kurioje dalyvauja 8 metų mergaitė D.K. Lietuvos pareigūnų neteisingumas, jos teisių pažeidimai ir netgi prievarta prieš bejėgį vaiką parodė, kad korumpuoti teisėjai peržengė visas ribas. D. atvejis atspindi daugybės atskirų žmonių padėtį Lietuvoje.

Todėl daugybė Lietuvos gyventojų leidžia dienas ir naktis prie D. namų, taip išreikšdami paramą ir ryžtą ginti šį vaiką nuo Lietuvos pareigūnų ir tarnybų. Susiklostė nepaprastai tragiška padėtis, kai Lietuvos žmonės turi ginti nekaltą vaiką nuo savo Vyriausybės, kad ši nepažeidinėtų jo teisių. Viliamės, kad jūs įsiklausysite į 85 proc. Lietuvos gyventojų balsą, kurių valios nepaisoma, ir suprasite kaip jie jaučiasi šioje situacijoje. Prašau įvertinkite šią peticiją ne tik iš 15 proc. gyventojų, kurie gauna naudos iš korumpuotų Lietuvos institucijų, perspektyvos.

2012 m. kovo 22 d. teisėjas V. Kondreatjevas įteisino prievartos naudojimą, kad būtų pašalintos „kliūtys“ perduoti D. jos biologinei motinai, kurią D. kaltina pardavinėjus ją pedofilams (tai tas pats teisėjas, kuris suklastojo „įkalčius“ prieš Lietuvos pilietį; pastarasis neseniai pabėgo į Jungtines Valstijas ir jį JAV Iljinojaus Šiaurinės apygardos rytinio skyriaus teismas atsisakė ekstradikuoti į Lietuvą, kas pažymima Šarūno Paberaliaus ekstradicijos bylos išvadoje.)

Tragedija, kuri nutiko dėl didžiulio prokurorų ir teisėjų daromo neteisingumo prieš D., susijusi su tuo, kad jos liudijimai apie labai įtakingų Lietuvoje asmenų – politikų, teisėsaugos pareigūnų ir verslininkų – dalyvavimą pedofilijos veikloje yra ignoruojami, o jie patys išnaudoja visas savo galias, kad perduotų mergaitę motinai (kurią ši kaltina sąvadavimu pedofilams) iki kol pedofilijos byla nebus išspręsta. Anksčiau vienas Vilniaus teismas nustatė, kad yra pakankamai įkalčių, kad būtų pateikti kaltinimai D. mamai Laimutei Stankūnaitei, tačiau prokurorai vis delsė tai padaryti. Maža to, vienas prokuroras paskelbė, kad jis norėtų, jog D. motina atstovautų ją šioje byloje! Iš pradžių teisėjai vertė D. praeiti daugybę neetiškų psichologinio patikrinimo procedūrų, kurių metu ji nuolatos liudijo prieš savo mamą ir pedofilus. Paaiškėjo, kad šie jos liudijimai teisingi. Kadangi teisėjai iš traumuoto, tačiau tvirtai savo tvirtinančio vaiko nesulaukė liudijimų, kurie būtų naudingi pedofilijos veikos vykdytojams, kuriuos šie desperatiškai siekė išteisinti, teisėjai nusprendė visiškai ignoruoti jos liudijimus ir nurodė perduoti D. motinai, kad taip užbaigtų šią bylą.

2012 m. kovo 23 d. mes su pasibaisėjimu stebėjome prievartą, vykdomą Lietuvos Respublikos vardu. Buvo mėginama iš senelės rankų išplėšti persigandusį spiegiantį vaiką, nuolatos kartojantį, kad ji nenori eiti pas mamą.
Prieš mergaitę kaukėti apsauginiai ir biologinė motina Laimutė Stankunaitė panaudojo jėgą, siekdami išsitempti ją iš namų. Be to, kaukėti apsauginiai vaiko akivaizdoje sumušė D. senelę, pagyvenusią moterį, taip pat ir jos seserį. Antstolė Sonata Vaicekauskienė prieš pedofilijos auką ir vienintelį gyvą liudininką stojo su mažiausiai trisdešimt ginkluotų policininkų, pasiruošusių ją pagrobti, kad apsaugotų atsakinguosius už šio vaiko pardavinėjimą ir išnaudojimą.

Toks mažo vaiko terorizavimas, kuriam sankciją išdavė ir palaikė Lietuvos pareigūnai, buvo nufilmuotas. Daugybė žmonių Lietuvoje, JAV ir kitose šalyse pasibaisėję žiūrėjo įrašą negalėdami patikėti savo akimis. Apie 9000 žmonių šiai dienai pasirašė peticiją, reikalaujančią Lietuvos pareigūnus nutraukti agresiją ir prievartą prieš nekaltą mergaitę (http://www.change.org/petitions/lithuanian-justice).

Smurtinė kampanija prieš D. 2012 m. kovo 23 d. nepavyko, kadangi vaiko teisių apsaugos darbuotoja nesileido antstolės ir policijos įbauginama ir nesutiko jiems padėti pabaigti savo smurtinės veiklos prieš panikos apimtą ir fiziškai sužalotą vaiką. Dabar antstolė, kad pasiektų savo, apmoko savo pajėgas ir planuoja dar agresyvesnį reidą prieš mergaitę.

Esame įsitikinę, kad perduoti D. jėga, prieš jos aiškiai išreikštą, dokumentais patvirtintą valią motinai, kurią ji kaltina pardavinėjusi ją pedofilams ir kuriai vis dar nepareikšti kaltinimai, nors įkalčių yra pakankamai, yra nehumaniška ir prieštarauja sveikam protui. D. turi būti užtikrinta teisė į sąžiningą pedofilijos bylos nagrinėjimą, kuri apimtų ir jos teisę liudyti ir (arba) kaip svarbų liudijimą pateikti ankstesnius pasisakymus.

Prašome, kad JAV Valstybės departamentas išreikštų savo poziciją šiuo klausimu, kadangi D. teisių pažeidimai prieštarauja ne tik sveikam protui, Lietuvos konstitucijai, Lietuvos įstatymams, bet ir kelioms Jungtinių Tautų Vaiko teisų konvencijos, kurią Lietuva ratifikavo 1995 metais, nuostatoms. Pagarbiai prašome įvertinti šią situaciją kaip vertinate ir kitus žmogaus teisių pažeidimus pasaulyje. Esame įsitikinę, kad Jūs nepriimtumėte Irano prezidento Ahmadinedžado aiškinimų, kad Yousef Nadarkani‘o mirties nuosprendis nėra žmogaus teisių pažeidimas, kadangi tai atitinka Irano įstatymus. Todėl mes tikimės, kad pedofilijos bylos klausimu jūs atsiklausite ne Lietuvos pareigūnų, kurie iškraipo parodymus ir dangsto pedofilinės veikos vykdytojus, bet pasitelksite patikimą nepriklausomą šaltinį.

Mes šioje byloje patyrėme pakankamai mirčių, tarp kurių yra ir mergaitės tėvas D.Kedys. Todėl mes manome, kad saugiausia mergaitei vieta gyventi – su teta Neringa Venckiene, kur mergaitė auginama jau keletą metų. Reikia tik vieno dalyko, kad būtų užtikrinta saugus mergaitės gyvenimas pas tetą – teisėjai ir valstybės pareigūnai turi liautis priekabiauti prie tetos ir bauginti ją už tai, kad rūpinasi D. ir siekia apginti jos teises.
